Top 4 aspecte de re\u0163inut"},"content":{"rendered":"<!DOCTYPE html PUBLIC \"-\/\/W3C\/\/DTD HTML 4.0 Transitional\/\/EN\" \"http:\/\/www.w3.org\/TR\/REC-html40\/loose.dtd\">\n<html><body><div data-elementor-type=\"wp-post\" data-elementor-id=\"25543\" class=\"elementor elementor-25543\" data-elementor-post-type=\"post\"> <section class=\"elementor-section elementor-top-section elementor-element elementor-element-62daf8e5 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"62daf8e5\" data-element_type=\"section\" data-e-type=\"section\"> <div class=\"elementor-container elementor-column-gap-default\"> <div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-1999eb8e\" data-id=\"1999eb8e\" data-element_type=\"column\" data-e-type=\"column\"> <div class=\"elementor-widget-wrap elementor-element-populated\"> <div class=\"elementor-element elementor-element-6c2a18e1 elementor-widget elementor-widget-text-editor\" data-id=\"6c2a18e1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\"> <div class=\"elementor-widget-container\"> <p>Posibilitatea &icirc;ncheierii contractelor individuale de munc&#259; &#351;i altor documente din domeniul rela&#355;iilor de munc&#259; &#351;i instruirii SSM, utiliz&acirc;nd <a href=\"https:\/\/www.certsign.ro\/ro\/semnatura-electronica-pentru-angajatori-si-angajati\/\">semn&#259;tura electronic&#259; calificat&#259;<\/a>, este reglementat&#259; explicit &icirc;n legisla&#355;ia na&#355;ional&#259;, cu aplicare din 25 iulie 2021, odat&#259; cu publicarea &icirc;n Monitorul Oficial a <a href=\"https:\/\/www.monitoruloficial.ro\/Monitorul-Oficial--PI--720--2021.html\" target=\"_blank\" rel=\"noreferrer noopener\">Legii nr. 208\/2021<\/a> privind aprobarea OUG nr. 36\/2021.<\/p> <p>Din noile reglement&#259;ri introduse &icirc;n Codul muncii &#351;i Legea securit&#259;&#355;ii &#351;i s&#259;n&#259;t&#259;&#355;ii &icirc;n munc&#259;, trebuie re&#355;inute urm&#259;toarele aspecte:<\/p> <h4><strong>1. CE? Semn&#259;tura electronic&#259; calificat&#259; poate fi utilizat&#259; de angajatori &#351;i angaja&#355;i la:<\/strong><\/h4> <ul> <li>&icirc;ncheierea, modificarea, suspendarea sau &icirc;ncetarea CIM (contract individul de munc&#259;);<\/li> <li>&icirc;ntocmirea tuturor &icirc;nscrisurilor\/documentelor din domeniul rela&#539;iilor de munc&#259; rezultate la &icirc;ncheierea CIM, pe parcursul execut&#259;rii acestuia sau la &icirc;ncetarea lui &ndash; anexe, acte adi&#355;ionale, fi&#351;e de post etc.;<\/li> <li>semnarea dovezii instruirii SSM (securit&#259;&#539;ii &#537;i s&#259;n&#259;t&#259;&#539;ii &icirc;n munc&#259;).<\/li> <\/ul> <p>Un alt aspect important este faptul c&#259; documentele din sfera rela&#355;iilor de munc&#259; semnate electronic se <strong>arhiveaz&#259; electronic<\/strong> <em>&ldquo;de c&#259;tre angajator cu respectarea prevederilor Legii Arhivelor Na&#355;ionale nr. 16\/1996 &#351;i ale Legii nr. 135\/2007 privind arhivarea documentelor &icirc;n form&#259; electronic&#259;&rdquo;<\/em>.<\/p> <p>&Icirc;n plus,<strong> organele de control competente au obliga&#355;ia de a accepta, pentru verificare &#351;i control<\/strong>, contractele individuale de munc&#259; &#351;i actele adi&#355;ionale, precum &#351;i &icirc;nscrisurile\/documentele din domeniul rela&#355;iilor de munc&#259;\/securit&#259;&#355;ii &#351;i s&#259;n&#259;t&#259;&#355;ii &icirc;n munc&#259; <strong>&icirc;ncheiate &icirc;n format electronic, cu semn&#259;tur&#259; electronic&#259;, f&#259;r&#259; a le solicita &#351;i &icirc;n format letric<\/strong>.<\/p> <h4><strong>2. C&Acirc;T? Cheltuielile de achizi&#355;ionare sunt deductibile<\/strong><\/h4> <p>Conform noii forme a art. IV din OUG nr. 36\/2021, modificat&#259; prin recenta Lege nr. 208\/2021, <strong>cheltuielile aferente achizi&#539;ion&#259;rii semn&#259;turilor electronice<\/strong> utilizate &icirc;n vederea semn&#259;rii documentelor de &icirc;ncheiere, modificare, suspendare sau, dup&#259; caz, de &icirc;ncetare a contractului individual de munc&#259;, <strong>sunt deductibile<\/strong>.<\/p> <p><em>&ldquo;(2) Angajatorul poate suporta, pentru el &#351;i pentru angaja&#355;ii s&#259;i, &icirc;n vederea &icirc;ndeplinirii obliga&#355;iilor legle men&#355;ionate &icirc;n prezenta ordonan&#355;&#259; de urgen&#355;&#259;, cheltuielile pentru achizi&#355;ionarea semn&#259;turilor electronice <\/em><em>[&hellip;] utilizate pentru semnarea &icirc;nscrisurilor\/documentelor din domeniul rela&#355;iilor de munc&#259;\/securit&#259;&#355;ii &#351;i s&#259;n&#259;t&#259;&#355;ii &icirc;n munc&#259;.<\/em><\/p> <p><em>(2<sup>1<\/sup>) Cheltuielile efectuate de angajator, prev&#259;zute la alin. (2), reprezint&#259; cheltuieli deductibile pentru determinarea rezultatului fiscal.&rdquo;<\/em><\/p> <h4><strong>3. DE CE? Semn&#259;tur&#259; electronic&#259; calificat&#259; are implicit efectul juridic echivalent al unei semn&#259;turi olografe<\/strong><\/h4> <p>Iar acest lucru este reglementat prin art. 25 din Regulamentul eIDAS nr. 910\/2014, aplicabil &icirc;n toate statele membre UE. Pentru celelalte tipuri de semn&#259;turi trebuie realizat&#259; expertiz&#259; tehnic&#259; ori de c&acirc;te ori este nevoie s&#259; fie demonstrat&#259; valoarea lor legal&#259;.<\/p> <p>&Icirc;n plus, &icirc;n cazul utiliz&#259;rii semn&#259;turii electronice calificate vorbim &#351;i despre <strong>eficien&#355;&#259; crescut&#259;<\/strong> (economie de timp, spa&#355;iu de depozitare, de resurse &#351;i costuri), <strong>utiliz&#259;ri multiple<\/strong> (certificatul calificat poate fi utilizat nu doar la semnarea documentelor de HR, ci &#351;i altor contracte\/documente de business ori &icirc;n rela&#355;iile cu institu&#355;iile statului), <strong>siguran&#355;&#259;<\/strong> (autenticitatea, integritatea &#537;i non-repudierea documentelor semnate, precum &#537;i identificarea semnatarului), respectiv <strong>accesibilitate &#351;i mobilitate<\/strong> (u&#351;or de utilizat, de oriunde, oric&acirc;nd, de pe orice dispozitiv).<\/p> <h4><strong>4.
