The electronic signature can now be used in construction, architecture and urbanism

The electronic signature can now be used in construction, architecture and urbanism, to obtain permits, agreements, approvals and authorizations, according to an emergency ordinance published in the Official Gazette at the end of last week. Thus, the documents prepared and assumed by specialists in these fields (architects, energy auditors, site managers, specialists in landscaping and / or urbanism, etc.) can be signed with a qualified electronic signature, having the same legal force as in the case of those on physical support, signed by hand.

According to OUG no. 140/2020 published in the Official Gazette no. 767 of August 19, 2020, the electronic signature can be used on documents and documentation developed and assumed in the areas of construction, architecture and urbanism, which are sent to the competent authorities and institutions with the issuance of permits, agreements, approvals and authorizations, as an alternative to their transmission in physical format with handwritten signature and professional stamp.

In the case of elaborating and presenting these documents in electronic format, to the authorities and institutions, it is necessary to fulfill the following requirements:

• to be presented in full in electronic form;

be signed by all specialists with a qualified electronic signature issued by a qualified trust service provider;

• to meet the substantive conditions provided by the legislation in force regarding the authorization of construction works, urbanism and landscaping.
